After losing on earlier grading permits, Native Directions/HomeCA now argues its revised manufactured-home plan should bypass further zoning and environmental review.
Last week, attorneys for Native Directions/HomeCA threatened El Dorado County with further legal action unless the County immediately approves revised permits for two large BHCIP-funded substance abuse treatment facilities (SUD) in Rescue.
Their latest strategy is to replace the previously proposed buildings with multiple manufactured homes and argue that, because manufactured home installation permits are ministerial, the County cannot require additional environmental or zoning review.
But changing the buildings does not change the project. These are still 30- or 40-patient treatment facilities proposed on rural residential property. The density, wildfire risk, evacuation concerns, road impacts and demands on local services remain.
The Board of Supervisors will discuss this latest legal threat in closed session on November 3. Rescue Deer Valley has asked County Counsel to continue defending the County’s authority to enforce reasonable zoning, safety and environmental requirements.
Please make your voice heard. Email edc.cob@edcgov.us and ask that your comments be distributed to all five Supervisors. Tell them you support continued County defense of appropriate land use, zoning and safety oversight for these projects.
