The defendant, Native Directions, requested a Writ Mandate to El Dorado County Planning Department to grant submitted permits for projects in Rescue (2) and Shingle Springs (2). The defendant argued that the grants expired at end of 2025 unless they broke ground in this calendar year, and as such requested emergency timing. The oral arguments and ruling were made over a period of one week.

The court broke consideration into two buckets based on the legislative law surrounding the grants. Two of the projects were stated to be funded through the Community Care Expansion (CCE) program and two through the Behavioral Health Continuum Infrastructure Program (BCHIP). The court granted the defendants Writ request on the CCE funded projects and rejected it on the BHCIP projects. The court compelled EDC to proceed with permit approvals for the Adult Residential Facility (ARF) CCE funded projects on 3480 Deer Valley Ct, Rescue, and 966 Best Life Way, Shingle Springs.

The court denied the Writ request for the BHCIP funded projects. The court didn’t state any explicit reason for the denail, but verbal discussions pointed to the additional conditions stated in legislation for BHCIP supporting need for CEQA reviews at a minimum.
