County Counsel Reaffirms: Native Directions Projects Must Meet Zoning, No CEQA Shortcut

Today Supervisor Parlin published El Dorado County’s response to the legal threat letter sent by Native Directions/HomeCA demanding approval of their pending permits and CEQA exemption request for four projects in Rescue and Shingle Springs. Read the full letter here. The County Counsel’s reply mirrors Rescue Deer Valley’s interpretation of the law and reinforces that these projects must meet relevant zoning requirements. Without that, the County cannot grant permits or concur with any CEQA exemption.

This response demonstrates that El Dorado County, and Supervisor Parlin, are not willing to be pressured, as of now, into approving these projects. The next move belongs to Native Directions/HomeCA. They could attempt litigation, but our reading of the statutes suggests that effort would fail. A better path would be for the developers to redirect their efforts to more appropriate sites and place these parcels on the market for single-family buyers. We will see.
