Great Question…

Today I got a great question through our contact form, and it reminded me that this issue can be complicated. The question was: “Where can I find that any ‘state analyst’ can change and approve information?”

This is a great question, and unfortunately understanding the answer took us time and research. The answer is:

“Any project approved by this program is automatically approved for zoning and CEQA. This is spelled out in AB172, see Legislative Details in the link below. This equates to an Analyst having authority to approve any development under this program, regardless of county zoning. That is what gives this developer the approval to build a 10,000 sq ft facility on a Residential plot, that is zoned for no more than 6 residents.”

When we originally approached El Dorado County (EDC) Supervisor Lori Parlin, she rightfully pointed out that the proposed development was funded under California’s Community Care Expansion (CCE) program, and as such the county could not enforce a required special use permit process, once a building permit was requested. This means the county can’t decline this permit based on the residential zoning of this parcel.

So how do we stop this development? One way is through public outcry. Your voice is critical to letting the county, and the state leadership, know that this development is not right. It endangers all of us who use Deer Valley Road, and it places unsupportable burdens on the residential community that surrounds these parcels. Please take the time to write our El Dorado County Supervisors, like Supervisor Parlin, to let them know this is not acceptable. Write to Governor Newsom, who will forward the note to the Department of Health Care Services. Let them know that they made a mistake approving this development without understanding the community impact of this location. Through our combined efforts we can get this development stopped.
